Tree of Life

Interesting how Rev. 22 talks about the Tree of Life being on the New Earth. I can only assume that it is the same Tree of Life-type tree (if it isn't the exact same tree) that was in the Garden, so please correctly me if I am totally missing something.

Can an assumption be made that people will know right from wrong on the New Earth and still have free will to choice to or not to sin?

The difference is that under the New Covenant, #torah will be written on the hearts of the people so they will automatically choose not to sin?
