The Apostles weren't accused of idolatry or even of teaching against Moses yet in Acts 5. The Sanhedrin would have to find false witnesses to bring those charges later. At this point, they were only accused of disagreeing with the Sadducees about resurrection.
And every day, in the temple and from house to house, they did not cease teaching and preaching that the Christ is Jesus.
Acts 5:42
Whatever charge the world brings against you, never stop obeying God and speaking of his goodness, no matter what anyone does or threatens.
And [Gamaliel, a Pharisee,] said to them, "Men of Israel, take care what you are about to do with these men..."

Gamaliel's advice to let God decide the question of the Apostles' supposed heresy in Acts 5:35-39 isn't universally applicable. In some cases (idolatry, false prophets, etc.), God has already passed judgment and told us what to do. I suspect that Gamaliel was sympathetic to #yeshua and The Way. I wonder what he thought of Saul's overzealous activities.
Contrary to popular Christian belief, the Pharisees were always the more moderate and reasonable party among the first century Jewish leadership. Yeshua aligned quite closely with the Pharisees on many issues, while he rebuked them harshly on some.
